Please ensure you have read and understood our Fair Use Policy, which forms part of the Terms and Conditions.
(a) Your use of the Home Services and/or Business Services must be fair, reasonable and not excessive, as reasonably determined by us by reference to average and/or estimated typical customer usage of the Home Services and/or Business Services. We will consider your usage to be excessive and unreasonable where it materially exceeds the average and/or estimated use patterns over any day, week or month (or other period of time as determined by us) (Excessive Usage).
(b) Any entitlements included under our Home Services and/or Business Services are offered for your own use and benefit only. It does not allow activities aimed at making profit or reselling the Home Services and/or Business Services, or using the Home Services and/or Business Services in an unfair or excessive way. Any such use by you is a breach of this Agreement. For the avoidance of doubt, fair use of our Home Services and/or Business Services excludes activities such as auto-dialling, continuously call forwarding, telemarketing, and call centres or other activities that use our services for commercial gain, torrenting, constant live stream.
(c) If in our reasonable opinion we consider your usage to be unfair, unreasonable and/or Excessive Usage we may immediately suspend, modify or restrict your use of the Home Services and/or Business Services or withdraw in full or in part your access to the Home Services and/or Business Services without notice to you.
(d) We may charge you at our discretion for Excessive Usage, which if we do so will be at our standard rates.
We want to make sure everyone gets to enjoy our awesome broadband and phone services so we need to make sure that everyone plays fair. Our Fair Use Policy means you cannot use the service in a way that is overly excessive or unreasonable. We've based it on how most people use the service. If you’re consistently thrashing the internet or phones, we will get in touch with you to let you know about some options, and if the excessive usage continues we may need to move you to another plan to protect everyone else’s experience.
